LEGAL BINDING NOTICE: By accessing elierfarms.org and purchasing from our curated network of breeders, you agree to comply with the following terms. These terms are designed to ensure the safety of our animals and the satisfaction of our elite clientele.
01
Introduction & Marketplace Facilitation
Welcome to Elier Farms. We operate as a premium facilitator and marketplace for exotic wildlife, livestock, and invertebrates. While we verify every partner in our network for ethical standards and health protocols, the final contract of sale exists between the Buyer and the providing facility, with Elier Farms acting as the primary agent of quality control and secure transport.
02
Animal Health & Live Arrival Guarantee (LAG)
We take immense pride in the health of our livestock. Our Live Arrival Guarantee (LAG) is 100% provided the following strict conditions are met:
- Signature Required: You must be present to sign for the delivery on the first attempt. Failure to receive the animal immediately voids all guarantees.
- Time-Sensitive Reporting: In the event of a Dead on Arrival (DOA), you must notify us via email within two (2) hours of the recorded delivery time.
- Evidence Requirements: High-resolution photographic or video evidence of the deceased animal and its original packaging must be provided. For high-value specimens (>$5,000), a continuous “Unboxing Video” is required.
- Autopsy Protocol: For rare morphs or megafauna, Elier Farms reserves the right to request a licensed veterinary necropsy. If the cause is pre-existing, a full credit or replacement is issued.
- Exclusions: LAG is void if the delay is caused by the carrier (e.g., mechanical failure) or if the customer provides an incorrect shipping address.
03
Legal Compliance & Permitting
The purchase of exotic wildlife is subject to federal, state, and local laws. Elier Farms does not provide legal advice.
- Buyer Responsibility: It is the buyer’s sole responsibility to research and comply with their local zoning laws and permit requirements before purchase.
- Restricted Species: We will not ship animals to states where they are prohibited (e.g., certain primates or reptiles in California, Hawaii, or New York).
- CITES Documentation: For international or regulated species (Appendix I & II), all necessary CITES paperwork will be provided as part of the transaction.
04
Payment & Cancellations
- Securing Inventory: Orders are processed on a first-come, first-served basis. High-value “Pre-Order” items require a non-refundable deposit to secure the specimen.
- Cancellations: If you cancel an order after it has been crated for transit, a 20% restocking and handling fee will apply to cover veterinary inspection, boarding, and logistics.
- Pricing: We reserve the right to adjust prices based on market rarity and genetic expression (e.g., specific morphs).
05
Shipping & Specialized Transport
- Weather Policy: For animal safety, we reserve the right to delay shipping if temperatures fall below 5°C or rise above 32°C at any point along the transit route.
- Carrier Choice: We only utilize specialized exotic animal couriers and Delta Cargo (Pet First) for megafauna and primates.
- Acclimation: Once the animal is in the buyer’s care, its health becomes the buyer’s responsibility. We provide detailed acclimation guides; failure to follow these guides voids post-arrival support.
06
Limitation of Liability
Elier Farms acts as a premium facilitator. While we verify every partner, we are not liable for damages, injuries, or zoonotic diseases resulting from the handling or ownership of exotic animals. Owning exotic wildlife carries inherent risks; by purchasing, you assume all liability for yourself and third parties.
07
Professional Consultation & Ethics
For estate placements (e.g., Giraffes, Zebras), a mandatory Site Infrastructure Review is required. We reserve the right to refuse a sale if the habitat does not meet our ethical and safety standards. Our commitment to animal welfare is absolute and non-negotiable.
